Two days ago, on 2nd March 2018, in a professional and friendly discourse with Suhakam Commissioner, Dato' Mah Weng Kwai , I brought up the unanimous judgment of the Court of Appeal (COA) involving the inquest for Teoh Beng Hock's custodial death, in which he was part of the coram judice. The judgment of the learned and honourable appellate court included the decision of my erstwhile professional mentor, Datuk Dr. Hamid Sultan Abu Backer JCA who held that "The criminal justice system has to be upheld". Prof. Hamid was also a defence lawyer. This is a well-known fact. I learned many "tricks of the trade" from him before an actual court appearance.
In my latest submitted article for Asia Times' publication, I wrote with the compassion and comprehension of a constitutional, civil liberties and defence lawyer and a human rights mindset for the victims of custodial deaths and their families and dependants.
But a certain paragraph referring to the Global Embarrassment of the 1MDB Kleptocracy Scandal - I unapologetically wrote with the practical approach, mentality and experience of a criminal prosecutor who has actually gotten convictions and imprisonment for criminals committing criminal fraud in the criminal courts.
Back to the judgment of the COA, I can only regurgitate what was already decided unanimously - "The criminal justice system has to be upheld".
Salus Populi Suprema Lex - The Welfare of the People Is The Supreme Law. It's very existence depends on it.
